Thanks. I did already confirm from the IRS website that the due date to recipient is the end of January. I guess it's a call to Chase's HSA department.

Jackie, that seems dumb that the IRS would create a system like that that virtually requires some people to file an extension!

Brokerages are the big one like MB said - and that's sort of new. They're required to track your cost basis, where before it was a "do it yourself" type of thing, so it takes them a bit longer nowadays. But, yeah - not all forms are due to be postmarked on the 31st. I even got a corrected 1098 yesterday (Thanks Wells Fargo!). Corrected forms, obviously, might take a bit longer.

Also employers can file for an extension of tax forms so check that out. I know my brothers employer filed for an extension as they were having problems with their HR system and could not issue w2's

For the past week, I have been waiting on a single tax form to be able to file. The worse part is that the 1099-SA from my wife's HSA won't even affect our taxes. Since we didn't take any non-qualified distributions, the entire second part of form 8889 is just a formality.

Now since tax documents are supposed to be received by Jan 30, do I have any recourse for their being late? This place has NEVER sent out the 1099-SA on time.

Not all tax forms are due by Jan 30th. One of mine isn't due until tax day itself, so I usually either get it in the nick of time or have to file an extension. I tried to look up the due date for that particular form but apparently am too sleepy right now to properly navigate the IRS web site ;)

At any rate I would start there, and then contact your wife's HSA if necessary.

You can always file now, and amend your return later if necessary.

Don't know, but it's a constant annoyance to me that brokerages have an extra month to send out their statements. I'm waiting on one statement that shows I got some dividend income. No transactions, nothing, but TD Ameritrade takes their sweet old time about it. Why can't they be held to the same standards as most, with a 1/31 deadline?
