The basic theme that I have for 20's automatically sets the footer. In atahualpa, i have the following for the year: %current-year%
I don't know how it works for other themes…

I have a Wordpress Theme that has the following php code in footer.php
<?php echo mysql2date('Y',current_time('timestamp')); ?>
Replace above code with: <?php echo date(Y); ?> and date should be correct.

You are technically still covered whether you change it or not and covered even if you don't have the copyright symbol or words listed anywhere on your site to start with. But, of course, it is always good practice to have it on there. Not that the scrappers really care though.
