That is pretty scary. More reason to be extremely careful when choosing a photo…it's just not worth it!

Righthaven is notorious for that. There were so many lawsuits on bloggers by them. A lot of them settle out of court for $5000-$10000 (for most bloggers that is a LOT). But their whole point is to scare the bloggers and settle out of court. If you google them, you can find a lot of case like that. The TSA pat down lawsuit was not their first and it won't be their last… The extra time we spend on finding a photo that is licensed to be used on commercial blogs is totally worth it.

There is even a firefox plugin to warn people when they visit a website that it is Righthaven owned I forgot the name of the plugin.

Whenever there is a thread on whether to take photos that have "non-commercial" license, I have been saying this – if you have ads on your blog, consider it commercial. Being extra cautious can only do you good.

A friend of mine had to settle out of court because he couldn't afford to fly his attorneys to Nevada for the case. He runs a forum and one of the users posted a full article instead of an excerpt. Righthaven served papers within a couple of weeks. This is a forum with no business model and no revenue, just a bunch of local folks with a common interest. They sued for $100,000 + the domain name. He settled for an undisclosed sum of around $5000.

I need to figure out a way to go through my old posts (about 3000 between two sites) and add attributions/remove images from my "hobby" blogger days. Any ideas on an efficient way to do that?

I'm no expert, but if you use Wordpress you could go to your Media Library and add attributions as captions to each image. It would at least be easier than going through each post…

Thanks for the post. Because of it, I am now being a lot more careful with how I do my images. I won't even use Zemanta anymore because it doesn't guarantee that the images are licensed properly, and I definitely know that Zemanta doesn't attribute them properly!
Eventually, I'm going to go through my previous posts and correct them just to be sure. I've always tried to follow copyright laws, but it looks like we now have to be paranoid about them. Sign :-/ Thanks again for posting this, I'd hate to learn the lesson from experience!

I have to admit this (and more research that I have done since reading this article) have made me paranoid. i think i will slowly be removing images from my site. To be honest, they are sort of a pain to include, anyway, and I have found I enjoy blogs that have no images just as much as I enjoy blogs with images.

I have used mostly common creative from flickr and my own photos, but I probably have one or two that I pulled off the net…. I'll have to go back and take down those photos.

Personally, I like images with a blog post. I'll have to do an audit on my earlier posts to make sure I attributed and that they were pulled from creative commons or other free sources (including my own).

I enjoy pictures and I'm trying to get a system in place to ensure that they are properly attibuted. I hope zemanta's link to the picture satisfies the license agreements. I'll have to do more research.

SPF- Zemanta looks pretty cool and it appears to handle all copyright attribution stuff for you. Is it as good as it looks? And am i reading correctly that it's free or is it just free for certain features?

At the end of the day, 99.99999% of people have the decency to contact you or your host to say "Hey, that's my content and I don't want you to use it." The other .0001% are sue happy.
Ridiculous, to say the least, but this is probably one of RightHaven's best income sources. I yearn for the day print media goes the way of the dinosaur.
