Thanks. It looks like we are going to be able to avoid the suit we were facing, but I'd still like to be able to put together a list of helpful tips in case anyone finds themselves in a similar situation.

I haven't been sued, but have done a lot of suing. Most of the lawsuits I have prosecuted were not in small claims court, but I'd be happy to answer any questions you have.

I have filed suits against several different companies in small claims court, but personally have never been sued myself.

Well, for those who have threatened to sue but were able to avoid going to court, what did you or the other party do to avoid that outcome? How did things get to that point in the first place? What

I didn't use a lawyer. I didn't win my suit, but did win on the counter-suit. I would do some serious research on the laws and gather a ton of evidence to prove your case. Be very direct in court and prove beyond any doubt that you are correct in the eyes of the law.

Many small claims suits do not allow lawyers (and it is not worth the cost, which can be more than the suit). If you are friends with any lawyers, couldn't help to ask them for direction.

A former lawyer friend of mine is now being charged with embezzlement of a trust fund that he managed, so be careful who you ask for advice…glad I never took his :)

No but I have sued 3 people. I am a landlord. I won all 3 times. 10 years later and I still haven't seen a dime.
